1. Introduction

AltPROP, Inc. ("AltPROP," "we," "us," or "our") operates a real estate technology platform at altprop.ai. AltPROP, Inc. is the technology platform operator. PROP Realty is a separate affiliated licensed Texas real estate brokerage (TREC #9013986) that provides brokerage services to platform users. This Privacy Policy governs information collected and processed by AltPROP, Inc. in connection with the platform.

This Privacy Policy explains how we collect, use, disclose, and retain your information when you use our website, mobile applications, and related services (collectively, the "Service"). It also describes how we route information through PROP Realty and the professional services marketplace as part of the Service.

By using the Service, you acknowledge this Privacy Policy. If you do not agree, do not use the Service.

2. Information We Collect

2.1 Information You Provide

  • Name, email address, phone number, and mailing address
  • Account credentials and authentication information
  • Payment information (processed by third-party processors — NMI/PaymentCloud, Coinbase Commerce)
  • Property listing details, search preferences, and transaction history
  • Government-issued identification for KYC/AML compliance
  • Communications you submit through forms, chat, or support channels
  • Signed agreement content (co-marketing agreements, buyer brokerage agreements)

2.2 Automatically Collected Information

  • Device and browser information (IP address, browser type, operating system)
  • Usage data (pages visited, time on page, click patterns, search queries)
  • Location data (city/state level from IP; precise location only with your consent)
  • Cookies and similar tracking technologies (see our Cookie Policy)
  • Blockchain transaction data (wallet addresses, transaction hashes — publicly visible on-chain)

2.3 Information From Third Parties

  • Payment processors (NMI/PaymentCloud, Coinbase Commerce)
  • Identity verification (Jumio)
  • AML/compliance screening (Chainalysis)
  • Real estate data providers and MLS systems
  • Social platforms (if you connect your accounts)

3. How We Use Your Information

  • To operate, maintain, and improve the platform
  • To facilitate property listings, inquiries, showings, and transactions through PROP Realty
  • To route your inquiry or contact to PROP Realty as your representing broker
  • To route contact information to service professionals you engage with through the marketplace
  • To verify identity and comply with KYC/AML obligations
  • To process payments and issue invoices
  • To send transactional communications (account, booking, signature, billing notifications)
  • To send marketing communications (you may opt out at any time)
  • To serve relevant advertising and sponsored placements on and off the platform
  • To detect, prevent, and address fraud, security issues, and policy violations
  • To comply with applicable law and enforce our Terms of Service

4. Information Sharing and Disclosure

We do not sell your personal information to independent third-party data brokers for their own unrelated marketing purposes. We share your information only as described below to operate the platform and connect you with services you engage with.

4.1 PROP Realty (Affiliated Brokerage)

AltPROP, Inc. and PROP Realty are affiliated entities. When you interact with the platform as a buyer, seller, or listing inquiry — including submitting contact forms, signing agreements, or requesting showings — your information is shared with PROP Realty to facilitate brokerage services. PROP Realty is bound by Texas real estate law, TREC rules, and its own privacy practices with respect to that information.

4.2 Platform Service Providers

We share information with vendors who operate services on our behalf: payment processing, identity verification, compliance screening, cloud hosting (Google Cloud), analytics, and email delivery. These providers are contractually restricted to using your information only to provide those services.

4.3 Legal Requirements

We may disclose information when required by law, court order, government regulation, or to protect the rights, property, or safety of AltPROP, PROP Realty, users, or the public.

4.4 Business Transfers

In the event of a merger, acquisition, or asset sale, your information may transfer to the acquiring entity. We will notify users of any such transfer and give you an opportunity to opt out where required by law.

4.5 Professional Services Marketplace

When you contact or book a service professional (photographer, inspector, contractor, etc.) through the AltPROP platform, your contact information and inquiry details are shared with that professional so they can respond to your request. This constitutes a "qualified connection" for which the service professional pays a per-connection fee to AltPROP. By submitting an inquiry to a service professional through the platform, you consent to your contact information being shared with that professional for the purpose of fulfilling your request. Service professionals are independently responsible for how they handle your information after receiving it, subject to our Provider Terms.

4.6 Advertising and Sponsored Placements

The platform includes advertising and sponsored placement features. Service professionals and other advertisers may pay for sponsored visibility in search results, directories, or other platform surfaces. Information about your platform activity (search queries, property types, location preferences) may be used to determine the relevance of sponsored placements you see. We may also work with advertising partners to deliver relevant advertising outside the platform. You can opt out of advertising-related data use by contacting privacy@altprop.ai. See our Cookie Policy for details on tracking technologies.

4.7 With Your Consent

We may share information in other ways with your explicit consent or at your direction.

5. Data Retention

We retain your information for as long as necessary to provide the Service and comply with legal obligations. The following schedule applies:

6. Blockchain and Cryptocurrency Transactions

  • Blockchain transactions are public and permanent — they cannot be deleted
  • Wallet addresses and transaction hashes are publicly visible on blockchain explorers
  • We cannot reverse or modify blockchain transactions
  • You are solely responsible for securing your wallet and private keys
  • We are not responsible for losses due to lost keys, compromised wallets, or user error

7. Data Security

We implement industry-standard security measures including encryption in transit and at rest, access controls, secure cloud infrastructure (Google Cloud), and regular security reviews. No method of transmission or storage is 100% secure. While we take reasonable measures to protect your information, we cannot guarantee absolute security.

8. Your General Privacy Rights

Regardless of your location, you may exercise the following rights by contacting privacy@altprop.ai:

  • Access: Request a copy of the personal information we hold about you
  • Correction: Request correction of inaccurate or incomplete information
  • Deletion: Request deletion of your information (subject to retention obligations)
  • Portability: Request your data in a structured, machine-readable format
  • Opt-Out of Marketing: Unsubscribe from marketing communications at any time
  • Opt-Out of Targeted Advertising: Request that your information not be used for targeted advertising or sponsored placement targeting

We will respond to verifiable requests within 45 days. Additional time-state-specific rights are described in Sections 13 and 14 below.

9. Cookies and Tracking Technologies

We use cookies and similar technologies to operate the platform, analyze usage, and deliver relevant advertising and sponsored content. You can control cookies through your browser settings or opt out of analytics and advertising cookies. For full details, see our Cookie Policy.

10. Children's Privacy

The Service is not directed to individuals under 18. We do not knowingly collect personal information from minors. If you believe we have collected information from a child, contact us immediately at privacy@altprop.ai.

11. International Data Transfers

AltPROP operates in the United States. If you access the Service from outside the United States, your information will be transferred to and processed in the United States. By using the Service, you consent to this transfer.

12. Changes to This Policy

We may update this Privacy Policy to reflect changes in our practices or applicable law. Material changes will be communicated by updating the version date at the top of this page and, where required by law, by direct notice to affected users. Your continued use of the Service after any changes constitutes acceptance of the updated policy.

13. Texas Residents — Texas Data Privacy and Security Act (TDPSA)

If you are a Texas resident, the Texas Data Privacy and Security Act (TDPSA, Tex. Bus. & Com. Code §§ 541.001 et seq., effective July 1, 2024) provides you with the following rights:

  • Right to Know: The categories of personal data we process and why
  • Right to Access: A copy of your personal data we process
  • Right to Correct: Inaccuracies in your personal data
  • Right to Delete: Personal data you have provided or we have collected about you
  • Right to Data Portability: Obtain your data in a portable format
  • Right to Opt Out of: (a) the sale of personal data; (b) targeted advertising; (c) profiling in furtherance of decisions that produce legal or similarly significant effects

Sensitive Data: We collect sensitive personal data categories (government ID, precise geolocation for KYC purposes) only with your consent or as required by law.

How to Exercise Your Rights: Submit a verifiable request to privacy@altprop.ai with "Texas Privacy Request" in the subject line. We will respond within 45 days (extendable by 45 days with notice).

Appeals: If we deny your request, you may appeal by replying to our denial notice. If your appeal is denied, you may contact the Texas Attorney General at texasattorneygeneral.gov.

14. California Residents — CCPA / CPRA

If you are a California resident, the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA) provides you with specific rights regarding your personal information.

  • Right to Know: Categories and specific pieces of personal information collected
  • Right to Delete: Request deletion of personal information (subject to exceptions)
  • Right to Correct: Inaccurate personal information
  • Right to Opt Out: Of the sale or sharing of personal information for cross-context behavioral advertising
  • Right to Limit Use of Sensitive PI: Restrict use of sensitive personal information
  • Right to Non-Discrimination: We will not discriminate against you for exercising these rights

Note on "Sale" and "Sharing": Under CCPA/CPRA, routing consumer contact information to service professionals through our connection marketplace may constitute "sharing" for cross-context behavioral advertising purposes depending on context. You may opt out of such sharing by contacting privacy@altprop.ai with "California Privacy — Opt Out" in the subject line.

15. CAN-SPAM and Commercial Email

We comply with the CAN-SPAM Act (15 U.S.C. § 7701 et seq.) for all commercial email communications. In accordance with CAN-SPAM:

  • All marketing emails clearly identify AltPROP, Inc. as the sender
  • Subject lines accurately represent the content of the email
  • Our physical mailing address is included in all marketing emails
  • Every marketing email includes a clear, functional opt-out mechanism
  • Opt-out requests are honored within 10 business days
  • We do not send commercial email to anyone who has opted out

To unsubscribe from marketing communications, click the "Unsubscribe" link in any marketing email or email privacy@altprop.ai with "Unsubscribe" in the subject line. Transactional emails (account alerts, booking confirmations, signature requests, billing notifications) are not marketing emails and are not subject to opt-out under CAN-SPAM.
